Morning folks, new to ARs. I have a pistol upper. Reading on the Internet just muddies the water. Can I attach this lower to a pistol upper? I see some say it can't have a rifle stock but others that are pistols and look similar. Trying to contact PSA is a lesson in futility. Thanks

Based on what you are asking: NO!!!!!

You MUST have BATFE approval for an SBR (short barrel rifle). A person "could" go to jail for this. Read up on what is required to own an SBR. I would like to have one but don't want to go through the hassle and expense.

It's not what you say, or think, that counts. It is what you DO!

No you cannot. That’s a rifle lower. You will need a pistol lower. Functionally, you you could the one you linked, but it would be illegal. Basically you need to get a lower, make sure the FFL processes it as “other” not as a “rifle/longgun”(FFLs among us, please verify that for me). Then you build it as normal, but never put a butt stock on it. You may either leave it as a bare buffer tube, or you may install a pistol brace, that looks a lot like a stock but isn’t, (google “what’s an AR pistol brace” and watch a video on YouTube). That makes it legal.

He’s not asking about SBRs. He’s trying to make sure he has a legal pistol.

Not as it's shown...

The lower you linked to would be shipped and transferred as a "receiver" since it is neither rifle nor pistol until assembled with a complete upper... a bare lower (regardless what is attached to the receiver extension) cannot fire a round and has no rifled barrel... therefore it is not yet a firearm of any type, but simply a "receiver", which is listed under "Other" on the 4473.

However once you have it, if you want to use it with a short barrel upper (barrel less than 16") you would need to first remove the sliding stock.

You could then legally install a short upper, and even add a brace (which resemble stocks but are not) to the buffer tube.

Thanks for the replies folks. 9x19, if the stock slides it cant be used? Perhaps the pistols I've been seeing had a brace. I'll google that and see what it looks like.

Ok, understanding more now. I see pistol lowers with braces, some for the same price. Since this is my first venture into this I think I'll get a mil spec lower from PSA. Any fault to that logic? Thanks

I thought once it had a butt stock installed it could never be a pistol lower. Or is it once it’s installed with a rifle upper.

Either way OP, but the pistol lower with a brace installed and you are g2g.

Nope... by the way, the sliding feature is also available in braces (ie SB Tactical SBA3 & SBA4). A brace can look alot like a stock, but ATFE makes a distinction between them.

These are two of mine:

Registered SBR with Magpul stock

And if your not married to the .223, look at a 9mm. I just finished the build on mine, and it’s a JOY to shoot.

Thanks! I've considered the 9. I'm really considering 80% route too.

If you do end up deciding to go with 9mm, look at FM products uppers and lowers. I’m very impressed.

I'm looking at building a 5.56 pistol with a new receiver set. I plan to use a 10.5 or 12.5 barrel with a sba3 brace. I just want to verify that it's legal and don't need to file paperwork?

Perfectly legal. I have one with the SBA3 10.5” barrel. Just don’t put a vertical foregrip on it, that makes it a AOW.

Thanks. What about adding a slr rifleworks handstop? Is it legal? I hear so many conflicting ideas?

Also, how do you like the sba3?

Thanks again

Hand stop is fine and angled for grips like the Magpul is fine. Just can’t be vertical. ATF rules are dumb.

SBA3 is pretty much a replica of the MFT Minimalist stock which is what I run on all my other ARs so I really like it. It’s almost comical that I can put this on a “pistol” and it’s perfectly legal but put on the MFT which the only difference is rigidity and I have to pay a $200 tax and wait for permission.

I appreciate it. Good to hear some solid info. The sba3 comes with a buffer tube, but no buffer spring, castle nut, or end plate, correct?

No problem, and yes it comes with tube only.

Yesterday, Primary Arms had the SBA4 and included a buffer and spring with the purchase. I think it was $130 if I remember correctly.

SBA4s can be had for less than $100... as low as $93 before shipping... use Gun Deals to search.

Buffer and spring isn't included, but PSA doesn't include them either, in my experience.
