There are several on here that should never take the stand either. None of us ever should. 10% chance it goes right, 90% chance it goes wrong. Keep your mouth shut is the name of the game. In similar situation, I think its best to not take the stand. But in a case where you aren't wrong, then for sure I would take the stand. Self defense, home invasion, I would absolutely. This situation, I would have prob plead out and hoped for a lenient sentencing. She was wrong, she knew she was wrong, and there was no helping her case taking the stand. Such a sad deal all the way around.

When asked if she shot to kill, she said yes. I really doubt the prosecution would accept a BS answer like “I was trying to neutralize or terminate the threat”, I’m sure he would have wanted clarification on that, “were you trying to scare him, wound him, or kill him?” Anything other than kill him should would have looked like a BS’er, don’t see how that would have helped.

I too think her mistake was to get on the stand and say her intent was to kill him. He had no weapon and due to the bullet trajectories I doubt the Jury believed the part of her story that he was standing upright, moving back and forth, then moving towards her while she gave commands holding a gun on him The Pathologist presented without a doubt due to the downward angle of the trajectory that Mr Jean was trying to get up off the couch, cowering, or ducking when he was shot. As would be expected after that first shot hit the upper corner of the apartment. The jury obviously did not see it as self defense. I don't think the castle doctrine is meant to allow you to go into your home with the intention to kill an unarmed trespasser who is presenting no threat. Sad situation all the way around.

IThe Pathologist presented without a doubt due to the downward angle of the trajectory that Mr Jean was trying to get up off the couch, cowering, or ducking when he was shot. Or maybe he was bending over to put down his bowl of ice cream.

She probably should of said she was not shooting to kill, she was trying to shoot the ice cream out of his had, she thought it was a gun.

I pretty much agree except for the couch part as I stated earlier, same sad result either way.

Yep, it usually isn't a good thing when the defendant takes the stand. Sometimes it works out but not very often. True, getting her to say she intended to kill was not good although pretty much the only answer. Didn't help either when she said she deserved whatever was coming and she was a piece of carp, kinda told the jury not to feel bad whatever they decided. Although her breaking down in tears when starting to recreate going into the apartment seemed genuine, after hearing about her sexting 2 days after the shooting seeming not very remorseful makes me think her breakdown on stand was more about herself than the victim and his family. I have to disagree with prosecution saying he was shot getting up from the couch because the laptop, ice cream and remotes on the ottoman directly in front of the couch were not disturbed and there was no blood on the couch or between the couch and halfway across the room toward the doorway where he fell. I see no way he made it that far with his artery severed without disturbing anything or bleeding on anything. I believe that he ducked with one shot going over him and the one one that hit him while he was approaching her. But he was not in the wrong, she was.... The medical examiner testified that the bullet entered at a downward angle, indicating he was below her when she shot, and she is quite a bit shorter than he was. The Dallas County medical examiner who performed the autopsy on Jean testified the bullet entered above his left nipple and traveled downward through the chest, hit a rib and struck his lung and heart. Gwin could not say where either the shooter or where Jean were positioned but agreed that Jean was likely bent over in some capacity or even on his back when he was shot. Hermus held a long stick against his chest and bent over to demonstrate the direction of the bullet to jurors. "Unless the shooter is on the roof of this room and shooting down, although that's a possibility, that's probably unlikely. Would you agree with that?" Hermus said. You could tell where blood was with how dark the video was, and when they blurred out the body, and with how much they were moving around? I couldn’t hardly tell anything in detail, except the general area where the body was and large items, such as his shoes, the TV, the couch, the bowl when they got right over it, etc. In the end, we both agree with your last sentence.

I think he walked toward her, a normal reaction, realized what was happening and ducked, the first bullet going over him and the second hitting him. Having been a delivery driver over 30 years I can understand the mistaken floor/apartment, especially someplace you have gone hundreds of times because you become less aware of the surroundings since you "know" where you are going. I have been on the wrong street, wrong floor, wrong house a couple of time and it was always in an area that I knew well because I wasn't paying attention I can even understand the instant feeling when the door opened, all focus went to the poor guy and "tunnel" vision kept her from seeing anything else. And at that point she was in the doorway confronting him and retreating might not have felt like an option BUT IT DOES NOT MATTER! Negligent homicide.....
