Is it illegal for me to sell a gun to a friend
.or anybody else in a private transaction? That's what we are led to believe from reports on the Midland shooter

Bill of sale does nothing but provide a receipt for the sale. If the ATF comes asking about a firearm you bought through an FFL at some point in the past, you can show it was sold. However, that does not prove you followed the law and did not knowingly sell it to someone that is not allowed to own / possess a firearm.

Both of pegasaurus' responses are correct.

To add to it, the proper way to protect yourself is to do the transaction through an FFL.

"Knowingly" is the key word there. You have no obligation to ask a buyer. The law also states that the felon had to be incarcerated within the last 5 years.

federal law says a felon can not be in possession of a firearm, matters not what Tx. says since fed. trumps it.

The Odessa coward had two tear drop tattoos under his left eye. If that wasn't a red flag, then the seller was a blind man.

The Odessa newspaper stated he had driven several hours from Odessa to buy the weapon. Apparently they know who the seller was. https://www.oaoa.com/news/crime_jus...abd8b1c-cea9-11e9-8432-23f182bcaa85.html

A law enforcement official reportedly spoke to the Associated Press Tuesday on condition of anonymity because the person wasn’t authorized to discuss an ongoing investigation. The OA confirmed through a different source that the gun was purchased in Texas illegally and that the gunman, Seth Ator, drove several hours from Odessa to obtain the gun.

Yup, the .gov would have to prove you "knowingly" sold to a felon. Tough litmus test.
