So after waiting 12 months, I recived by tax stamp application back. It had a big red stamp on it. "RETURN WITHOUT ACTION". Anyone else ever seen this? After a week and a half of placing phone calls, emails, ordering my own background check, I have finally figured out what happened. The FBI background check was left in "open" status because of incomplete information at the state level. So, instead of alerting me that there was an issue...not an issue that would get me turned down, like a felony conviction, but an issue of incomplete documentation at the state/local level...they decline me. Once I figured out where the issue was, a quick call to DPS records department, and an email to them, and it was solved in less than 24 hours. Here's what burns my [censored]. They won't re-do the FBI background check and continue on with my application. I now have to wait for my refund of $200 and get back in line again! mad I hate the ATF.

Sucks...new background system is not going smoothly. I know some people have had success reaching out to there congressman to get help

I had a form declined over a clerical error. They could have sent a request for correction, but they flat refused

In the real world, people get fired over mistakes like that. It's unbelievable.

What happens if you already own NFA items and they make a mistake on your application that causes you to be denied for a new item? Will they try to take your original items since you "failed" a background check?

It's funny you believe they can connect the dots like that.

As far as I can tell, the level of work achieved is your typical 300 pound woman that clocks in one second before required time, takes all scheduled breaks, meets just enough quota to stay out of trouble, and clocks out one second after required time.

Did you file the form as an individual, trust, or LLC?

I filed as an individual. Interestingly, i had to pass the same background check to get my CHL. Then, I assume they do another background check to renew it as a LTC. I had no issues there.

My uncle went through the same thing when purchasing a full auto. He has his son on the trust, and his son has been to the Middle East numerous times. Apparently the NFA isn’t great at researching why he went over there, they just saw all his trips and where he’s been. He was a private contractor for a few years. His stamp sat in wait for 17 months before finding out it was denied.

Write your congressman and a lot of times they will be able to help you in situations like this, I know a few people who have had similar issues.
