District Attorney Laura Nodolf released the arrest affidavit of probable cause in the shooting death of Midland Police officer Nathan Heidelberg.

According to the court documents, when officers arrived, they walked around the residence of David Charles Wilson and did not observe anything out of the ordinary.

Officer Heidelberg noticed the front door was not secure.

Heidelberg radioed back to dispatch as two other officers arrived to assist.

One officer heard Heidelberg announce that Midland Police officers were on the scene.

That officer said he then heard a gunshot and asked officer Heidelberg and the others if they were okay.

All responded yes.

Then he heard a noise and found officer Heidelberg lying face down.

The officer attempted life saving measures and Heidelberg was taken to Midland Memorial Hospital.

Heidelberg died around 2:20 a.m.

Texas Ranger Cody Allen spoke with the homeowner.

Wilson admitted he was inside the residence and fired a gun in the direction of the officer.


The Ranger says in the affidavit that there is no evidence of anyone else discharging a firearm in the direction of the officers.

Allen says he had probable cause to believe David Wilson committed the offense of Manslaughter by recklessly causing the death of officer Nathan Heidelberg.

I got a couple more questions.

Did an alarm come out at that residence? Wouldn’t that wake the owner? And he expect the police to arrive.

Secondly. What idiot shoots at a flashlight without a little more assessment?

Very sad for the officer and his family. I wonder if the police car lights were on? Did they say for sure if he was shot inside the house or outside? If the alarm was sounding then I would think, obviously, the homeowner thought the officer was the intruder.

If I see a flashlight inside my home in the middle of the night I'll be shooting first and asking questions later. What assessment would someone recommend when they think an intruder is in their home? I wouldn't think it would be wise to give up your position or make any verbal announcements.

Also, when my alarm goes off the alarm company calls immediately and asks if we want officers to be sent. I'm sure most alarm companies operate this way.

Problem with this deal is the homeowner has the resources to hire whatever legal team he wants. His side may just end up being a Attorney’s narrative. IMHO the officer was training a LEO and there is no way he did not announce his presence. angel
