On my lease in Comfort, in the past has always been on a handshake with the Man who leased the grazing rights and subleased the hunting rights to us. Well, as you are all familiar with. The man is old and has turned it over to another. As far as the "hunting" rights. The family has taken this over.
with all kinds of "stuff" thrown in. Not good. SO, does anyone have a copy of their "lease", so I can see what one should look like. I'll look on the "net" see what I can find.

The real estate center at Texas A/M publishes a sample copy you can download. Pretty generic but you can add what you need for a specific property. Good luck, Buzz.

I should have a couple from my current and previous lease but current is MLD3 and previous was highly customized family lease ... I'll see what I can find

A lease may be anything from a handshake, to a formal, legally binding document, written by an attorney. Either way, the most important factor is the integrity and honesty of all involved parties. If the lease is not going to be honored by the LO, or followed by the hunters, it is of little value.

If it's for over a year and you want it to be enforceable, the lease has to be in writing (statute of frauds).

A verbal agreement is a legally binding contract. It is common if both parties know each other and are of high character. With that said a written contract that spells out the details of the agreement, and the term, is the way to go. It protects both parties and should alleviate any misunderstandings between land owner and the party he leases to. Unless you know the landowner well, you should get a contract that includes a map and legal description, states the term of the lease, and any rules the landowner has. You should also get a signed and dated receipt marked paid in full when money changes hands.

Buzz lease agreements are like Prenups they only protect what’s stated, make sure you have a line in there granting exotics and defines “limits” and “size” etc

I hate it when this happens we got the boot years ago from a lease when the person we were dealing with turned it over to the family. We had done nothing wrong and were always respectful on the place. Buzz may be time to move on.
