Has anyone ever had to lemon law a vehicle? I bought a new truck in June 2018 and the AC has now stopped functioning for the 3rd time since then. Does this sound like it qualifies for lemon law? Is there anyone who has been through the process that can offer advice?

I filed a hand written complaint before we had email. They jumped on it. We were about to meet when the dealer made only last try and fixed the problem.

I may try that. Not that I expect them to do much about it but I don't want to jump straight to being an A hole about the situation.

I had an issue with a Nissan and I talked directly with the sales manager. He bought it back for what I paid. Probably won’t work every time but I’d sure try that before proceeding. I’ve heard it is a huge pain to get it done especially since that’s not a mechanical problem. Mine would fill up with water every time it rained. Replaced all the windows and seals 3 different times.

Sounds like you're on track for it but I suspect they'll get it fixed before they take it back. There are hoops to jump through and particular requirements to meet. Document everything as best you can.

This reminded me of an Expedition my wife had. Not long after we bought it, the A/C would quit, and then miraculously start working again. After several trips to the dealer and no progress, they changed the compressor, dryer and condenser out of frustration I believe. A few weeks after the last trip to the dealer, we were in it and I heard a clicking noise deep in the dash and it quit working, and I had a good idea what was happening then. When we got home, I pulled it apart and found an ink pen in the blower fan. I told my wife, and she said the dealer must have left it in there. I then handed her the pen with the Logo from her job, and she never said another word.

You send a written request to the dealer that you want the truck replaced per your right under the Lemon Law.

They're are specific requirements that must be met that you might me eligible for or you might not. If your not they will cite why in their response to you.

If you qualify, they will use a 3rd party company to negotiate a settlement with you.

I had a truck bought back in the early 2000s. It only came after several months of the truck being in the shop with no fix, up to and including a new engine. That was for a mechanical issue that kept the truck from operating, an HVAC issue is going to be significantly more difficult to pursue. Check out the laws that pertain to it, you'll have to meet the criteria exactly in order for it to happen.

Mine took almost 18 months from purchase. It was, and forever will be, my last new vehicle purchase from GM, and the very last time I ever do any business with the Ewing family of dealers.

Has to be within the first two years/24k miles of warranty AND been in the shop four times for the same issue.
OR
Been in the shop for at least 30 days.

And I wouldn't mess with the local dealer, go straight to a regional director or Ford Customer Service......

I had a Ford that had problems, and after talking with the owner and the regional Ford rep they agreed to match the Lemon Law deal without actually going through it. The bought the car back for what I paid, minus the legally specified depreciation. Ended up buying another Ford from the same dealer (at a great deal) and went on with life.

Once a buy back is done the truck then gets a branded title, the way they did it there is no record. I would put money on it they sold yours without listing any issues you were having.

How do I know if my vehicle is a lemon?
A motor vehicle may be declared a lemon if it meets all of the following conditions:

The vehicle has a serious defect or abnormal condition.
The defect or condition is covered by a manufacturer’s written warranty.
The owner reports the defect or condition to the dealer or manufacturer within the warranty term.
The owner gives the dealer or manufacturer a reasonable number of attempts to repair the defect or condition.
The owner gives the manufacturer (preferably by certified mail) written notice of the defect and at least one opportunity for repair.
The defect or condition persists and substantially impairs the vehicle’s use or market value, or creates a serious safety hazard.
The owner files a timely Lemon Law complaint and pays the filing fee.
How many chances does the dealer get to fix the vehicle?
Determining how many chances a dealer has to fix a defect is easy. Simply see if you pass either the four-times test, the serious-safety-hazard test or the 30-days test.

The law presumes you have given the manufacturer or authorized dealer a reasonable number of attempts to fix the defect if you pass one of these tests. The mileage requirements generally do not apply to TRVs.

Four-times test
If you have taken the vehicle to a dealership for repairs:

two times for the same problem or defect within the first 12 months or 12,000 miles, whichever comes first, and
twice more during the 12 months or 12,000 miles after the second repair attempt, and
the problem is still not repaired
you pass the four-times test.

I had a 1985 Bronco II that I bought brand new. The rear drivers side window leaked like crazy. I took it back to the dealer 5-6 times and they never could get it to stop. They ended up replacing it with another Bronco II.
