Scope is not new and box and is a fixed 4.5 power. I contacted seller and he cussed me out and when I hung up he sent me a threatening text message.

Buyer beware.

True it is a 4.5 fixed power manually but electronically it can be changed to 9 in the settings, I have one just like it and it works at both powers. Just checking to see if you tried that. Don't have a horse in this race just giving some info.

After some research you are correct and I apologize for the magnification statement.

However the scope has a ringmark and has been removed from the box.

The seller could have told me what GLC was kind enough to do with out cussing or yelling. However I never got that far with the seller, we were still on the definition of NIB when the anger came out.

I only know how he has been with me that in your eyes is an anomaly. Ive never met the man and this is the only experience Iíve had with him it is my entire belief of his character so you see how perception is subjective. Iím sure he is a great man and he would feel the same of me. We got off on the wrong foot and Iím positive a good conversation will clear all this up. I offered to refund his money if he returned the scope to me. Iím waiting for his response.

Your perception is certainly subjective. Do a little research.

New in box doesn't necessarily mean the item has never been opened, but it should mean that the item has never been used. The man offered a refund when the item is returned. There is nothing more he can do. It also appears that TEXASLEFTY didn't do his research and didn't know what scope he was buying.
