I am going to do some public water hunting this year and because I haven't done a lot of it I called the game warden for one of the counties I'm going to be hunting in just to ask a few questions about the lake.

He told me that I had to stay in my boat to hunt. I asked if it was ok to stand in the water? He said no. This is a public lake but the land around it is private. I understand that the land is private but I don't understand why I wouldn't be able to set up somewhere where I could stand in the water and hide the boat. I had him clarify that twice.

Does this sound right?

Hmmmm doesn't sound right to me with the info given. I would do what the warden said for now.

This doesn't sound right. The law used to be you could hunt anywhere the water went. Over time it changed and you could only hunt the main body of the water (like river channels). People can still fish anywhere the water goes but not hunt. If the land underneath is owned by citizen you can't even hunt out of a boat. I could be wrong but I think he has this a little bass akwards. Are you sure he didn't think you meant park the boat and hunt from shore?

Some places use terms like "accessible by boat only" and/or "no hunting from land or the shoreline".
For example the restrictions for the Vine-
All waterfowl hunters are required to be in or on the water while hunting waterfowl. “In or on the water” is defined as being at least six (6) feet into the water from the shoreline, either wading, in a floating blind, or in a boat. Shore-based blinds are not permitted.

He might be confusing something like that with no standing on solid ground in the water. Call the water body controlling office or the lake manager/ranger and ask them.

Warden doesn't sound right to me. I hunt a lot of lakes between you and me and have never had a problem.
Fact is, the only time I see a GW is at the ramp. Besides, you can swim in the dang lake, why couldn't you walk in it?!

Not knowing the lake you're talking about, I'd guess there are special regulations for that particular lake (assuming the game warden is right). Like others have said, it doesn't sound like he is...

Could be a special reg for the lake or a misinterpretation?

I've had the GW tell me his interpretation of something, then read the actual reg/applicable law to him and be responded to with "not in my county".

Go higher.

Boat definition: a vessel for transport by water, constructed to provide buoyancy by excluding water and shaped to give stability and permit propulsion.

I think waders can fit that definition.

Odds are its Lake GV and COE has gotten hell from home owners that live on that lake about hunters so they made some BS Reg's to make it a PITA so no one really wants to hunt.

I know some lakes in CenTex that you can only hunt from your boat. You need to contact the lake manager and they can tell you.

I am aware of at least one public lake in Texas where the controlling authority published rules do state you must remain in your boat. This was not a TPWD, Corps, or navigable river. There are more than a few lakes with really off the wall area specific hunting rules. One DFW lake for example requires your retriever to wear florescent orange "while hunting". At least per that areas published rules.

I had a GW tell me that I could follow the water line and hunt...foot or boat. Just don't get within the boundaries of permanent structures, etc. As long as i stayed in the water he said I was ok.
