Can't sight in Vortex Viper 3-9x40

Bought a new Viper. Got it on paper but it won't adjust downward like it should. Got it to about 3" high then adjusted down about 8 clicks and it stayed the same or moved up slightly.
I've never had issues with the gun. It's a .25-06 and shoots sub MOA groups with almost any ammo. I've checked everything for tightness.
Vortex tells me that my rings may be to tight. But I'm finding it hard to have faith in the scope now.
Have any of you had similar issues in the past? Suggestions? I can send it in but wanted to get your thoughts first.

I put a vortex on my new savage with a 20 moa base and ran into the same problem. I maxed out the downward elevation adj and was over 2 feet hi still. Bought a 0-moa base and was about 6-8 inches hi at 100 yards.
Finally bought a set of Burris Sig Z rings and set them up for max adj down (front ring fat side on bottom and back ring fat side on top) and was able to get it sighted in. You may just be out of internal adjustment with the scope.

Are you running an elevated base?
+1 If it's a Viper PST it is designed to be on a 20 MOA base. I don't know if the non-PST are designed that way. I bet not.

The viper I saw on their website said it had 92 Moa of travel...

I have a vortex viper HS LR it is advertised with 75 MOA of vert adj but has 82 if you actually turn the turret from top to bottom or vice versa. It would not site in with a 20 moa or even 0-moa base I have a -10 moa set up on it and its only 6 inches from bottoming the down adj again. All the guns receivers are different.

All the guns receivers are different. You ever see the piece of steel that will be machined into an action? It's a piece of round bar. When they're done they're not 30 MOA out of parrallel. That was a scope problem.

That was a scope problem. Possibly, possibly not. Yeah its round bar, so if you drill/tap one of the holes off center it will also fudge up your vertical. I also ran out of windage adj on mine it was about 2 foot hi and 1 foot to the right with windage and elevation maxed out. Im guessing the rear hole was drilled to the right and front to the left or some combination thereof. Scope works fine. Maybe some part of the reticle was assembled wrong, but I still have the full range of adj. I had to use the z-rings to adj for verticle and left/right.

I have one of the original vipers no issues, I'd call vortex tell them to send you another.

A windage problem, absolutely holes can be drilled off center. I have one Rem 700 action that the front screw hole was about half a hole width off to one side. I milled the corresponding scope base hole into a slot so it would capture both. Every time I've seen an elevation problem it was too much elevation on the rear of the base or a scope problem.
The Zee rings are a good way to help with these problems on your average hunting set up. I got away from them and went to more robust rings, bit the Zee rings can get things aligned if you have time and patience.
I'd send the scope in question back to Vortex.

Low rings. Standard bases. I didn't have to adjust all that much to get on paper. Think I will play it safe and have it looked at. I had a Nikon on there and replaced with the Vortex for a little more eye relief. Sighting in the Nikon was a breeze.

Sighting in the Nikon was a breeze. Hmmmm. Hasn't been the case lately on my range. Them or Leupold. I have two Nikons. One a Buckmasters from 05 I think and a Tem Primos from around 07 I think. Those have been great. I bought another Buckmasters last year for another gun and It doesn't seem quite as nice as the older ones. I wondered if something changed in production between those 2 periods.
