LA Man Gets Federal Prison Sentence for Repeat Violations - 03/13/15 03:43 PM

I'm glad to see that they are giving a repeat violator more than just a fine.

A Thibodaux man pleaded guilty in Federal Court in Orleans Parish on March 10 for hunting with lead shotgun shells and violating terms of his probation, according to the Louisiana Department of Wildlife and Fisheries.

Judge Joseph Wilkinson Jr. sentenced Lloyd Badeaux, 67, to pay a $560 fine for violating non-toxic shot requirements and to serve 30 days in jail for violating his hunting ban from a previous conviction.

Additionally, Bobby Chauvin, 76, of Theriot, also was fined $560 for using lead shot in the November, 2014 incident, the release states.

Badeaux was first cited for taking over the limit of ducks in January of 2012 in Terrebonne Parish, when agents found him with 48 black-bellied whistling ducks over his daily limit. In that case, Badeaux pleaded guilty and was fined $5,010 and placed on three-year probation with no hunting.

But prior to the opening of the 2014-15 season, agents received information that Badeaux would be duck hunting on opening day near Dularge.

A surveillance operation was set up, and on Nov. 15, 2014, agents found Badeaux actively hunting ducks with Chauvin. According to the release, both men were in possession of lead shotgun shells in the blind.

He was banned from hunting for 3 years as part of a previous violation in which he was convicted of overshooting his limit by 48 birds.

I bet this old guy will still hunt ducks. He's not some young dude that duck hunts just to validate his DU sticker or his decoy carving or call making hobby. He hunts ducks because he loves to kill ducks.

...and I bet his gun is fixed full choke and shooting steel through that thing would be dangerous

The crux is legality, which in a civilized world would determine whether one is an exceptional sportsman of the highest caliber, or an asshat.

It could go either way depending on which side of the border you're standing on.

Trap 48 wild ducks. Try removing said birds from trap while alive. While standing in water.

As do I.

Only time I've removed trapped ducks or assisted with trapping ducks was for banding. It was difficult getting the birds out safely without injury, and the hunter in me had me thinkin if these tree hugger volunteers only knew how many of these same ducks I'd killed over the years, and how much easier it would have been to get them out of the trap if we could just shoot them first smile

fwiw, it's OK for the biologists to know you hunt, but never ever let the other volunteers find out you hunt, particularly if they're female, and particularly if they find out you've hunted the same birds you're working with. Otherwise, you'll end up with a not-so-nice nickname.

Yep...I'm really surprised that so many people think this penalty is too harsh. The rules are the rules....if all people got was a really minor slap on the wrist when they were caught poaching (especially repeat offenders), we probably wouldn't have enough ducks left to hunt in 50 years. This guy apparently didn't get the message the first time when he was fined $5000 and given probation.

As with most cases of law breakers, most criminals think they are smarter than LEO and won't get caught. This guy has become a poster "child" for LEO. up

lol...... I've damn near filled the bed of a pickup with crow and squirrel carcasses from my folks pecan orchards. And yes, crows eat a lot of pecans. Even propane cannons won't keep them away for long.

I should qualify my statements...I'm not saying shooting 48 mottled ducks is ok, but 48 ringers or mallards is not to bad in the big scheme of things

I can remember when I was a kid and I could go down to wal mart and buy a box of duck and pheasant load #4 lead shot. You remember, the ones that had the duck on one side and the pheasant on the other? Maybe these old dudes had some of these old boxes of shells laying around and didn't see the pheasant and lead shot part. Ha ha

That #4 lead sure did work good on them ducks and was a lot cheaper. I do realize how lead took its toll on the waterfowl in the way of poisoning them. When I was a kid, I used to walk around with a pellet gun in short shorts, tennis shoes with no socks, in rattlesnake country, with a mouthful of lead pellets in my lip like a chew because I didn't have any pockets and I didn't have any socks to put them in either. My buddy said he used to do the same thing and he's about 15yrs older than me. Maybe that's why we're both a little throwed off. We didn't know lead was poisonous.
