Can you LEGALLY shoot a deer that you know jumped a high fence?

You can randomly shoot any legal deer that has wandered onto property where you have the legal right to hunt. It is better, however, if you shoot the deer in a vital area since random shooting can injure but not kill the animal causing undue suffering.
FWIW, whitetail deer are the property of the state, therefore the state regulates their kill or capture. This does NOT apply to exotic game which can be killed year round.

The land owners bordering me have high fence with some genetically enhanced deer, I've been waiting for one to take a leap of faith. I don't think they could actually recover or capture the escapee in thousands of acres that isn't high fenced. If it ever happens I would rather it spread its seed than someone shoot it the first day it escapes

Yes you can shoot it, if noticed in the beginning of season I wouldnt target the deer til the end of the season or the following season.
