Private rifle sale to non resident question - 01/03/16 06:15 PM

In Texas: Private sale of a rifle, non ffl to non resident non ffl. Legal ?

If not, could a Texas FFL be used to transfer, or should I just ship it to an FFL in their state?

Ship it to FFL in their state.

Is the transfer local or across state lines? That is, is it a face-to-face transaction?

Contact the FFL first to make sure that they will accept a shipment from a non FFL... some won't.

The buyer is from out of state, here for a few days on business, wants to do ftf privately. It's a rifle.

I told him I'd have to research it first. I don't want to deal even in a gray area here.

Pretty sure you are good to go.

Maybe someone can post a copy of the law.

From what I've read, you can't do a ftf. You need to send to an ffl in his state.

You are doing nothing wrong if you sell to him as long as you know nothing that disqualifies him. He may have an issue if he is crossing state lines that do not belong to Texas too.

I know nothing of this legal stuff tho...

Nope, he can not transfer a firearm to someone that is not a resident of the state of Texas without using a FFL.

Deal has to go through an FFL. Cannot do a private sale with an out of state resident.

Ok, well there you go, you know something that disqualifies him. He is not from Texas.
