It's more than a pity. It is a barometer of the "anti-gun" fools gradually gaining traction among the sheep.

They're not the first to do this and they won't be the last. Unfortunately, I have no doubt there are many other cities watching to see how this stands up so they can follow suit. Someone is going to have to take one for the team and push it up the chain. A ruling from some appeals court that this type of ordinance is unconstitutional would go a long way toward preventing a lot of other cities from passing these things.

I'd say the legality of this depends entirely on state law and how it's written or not written. We just recently seen an incident with CJ Grisham where a city established an ordinance about the open carry of long arms in which he was in violation of. Was the ordinance enforceable, I have to say yes. Reason being is the states position on open carry of long arms. From my reading the state doesn't specifically say that the open carry of long arms is legal nor does it say they are illegal, problem is it says nothing. This is the gray area which led to the ordinance and why I believe it was enforceable had they pursued. The ordinance didn't violate state rights since the state has not taken a position on the subject of long arms. The cities cannot establish an ordinance against concealed or open carry since the state has already taken a position on those. The state doesn't have a law saying we can grow our grass as high as we want, or park our vehicles in our front yards. Again it say nothing leaving cities to pass their own ordinances which are legal and enforceable. This is just my take on it and the reason I mentioned the state needing to make a ruling on the open carry of long arms. No law or no position on a subject leaves it open for funny business.

Yes sir, there is a suit in Illinois right now, but I cant recall the details, but it is because of a mirror ordinance.

I'd fight the Constitutionality of the ban. A "well regulated militia" means the firearms in question must be more that a small "bird" shotgun. The Militia Acts of Congress in 1792/1793 required every able body man to report to militia service with a SUITABLE rifle or musket. Since the right of the "people" to keep and bear arms shall not be infringed upon, you could argue that an individual could be checked for a criminal background, etc. Denying that one individual the ownership of a firearm doesn't really effect "the people" but to categorically deny a militia type arm ACROSS THE BOARD to apply to all people in Boulder. That infringes on the collective right of the people in Boulder from owning firearms suitable for use in a well regulated militia. A clear cut situation.
