MARFA – The State of Texas has filed motions to dismiss charges against hunting guides Walker Daugherty and Michael Bryant, who were both arrested following a shootout at the Circle Dug Ranch, which left Daugherty and a Florida chiropractor wounded.
Attorney Rosario Peralez of 83rd District Attorney Sandy Wilson’s office told 394th District Judge Roy Ferguson the state has filed the motion to dismiss the cases after communications with law enforcement and looking at the case “with fresh eyes.”
The state, she said, will be sending the case back to the Presidio County Grand Jury for expected re-indictment in October.
Initial reports from the hunting party pointed toward undocumented immigrants having raided the hunters’ campsite and initiating the shootout.
Investigations by U.S. Border Patrol agents and the Presidio County Sheriff’s Office refuted the claims, with no evidence pointing toward any illegal entry into the ranch from Mexico.
Judge Ferguson extended the final plea deadline for both men to the November 6 docket call and carried forward the motion to dismiss to the same date.
