If you don't have a trust and only go the fingerprint passport route rather than trust? Can they still be left to someone?

You should ask a lawyer, but I think you can leave them in a Will one time to someone. The next time requires another $200 stamp.

I have a trust but I was just thinking about it and didn't know the answer. I should have googled first bc there is plenty of info on it. Apparently there is a tax free transfer form5 for these situations.

The interesting question is this: what happens when a proscribed person inherits an NFA item.

It's an interesting issue, and the BATF has already issued policy statements on the subject. It boils down to the proscribed person has ownership for the purpose of transferring ownership but may not take physical possession.

You can use a a form 5 to transfer tax free or destroy and notify atf

If the item is part of a Trust,it stays with the trust.The trust owns the item,not the person that paid for it. One of my best friends passed away in April,his suppressor is in my trust,and now resides in my safe. None of his family was interested in it,and didn't want me to add them to the trust.
Just one more reason to have your NFA items in a trust.
