I find it hard to believe that someone intentionally poaching would build this stand. I would check with the neighbors to see if they have giving permission for someone to hunt there. My guess that it's a young college kid that "should" have known better. I would also contact the game warden and make him aware. He will catch him. For good measure, add a couple of cameras to get pictures.

Trespass with a firearm is a Class A misdmeanor. Goes up from there if you actually catch them shooting an animal.

Don't be surprised. My parents (in Virginia) live on five acres in the woods but it's in town. Bow hunting is legal there. A locally well known doctor that has a house on the same road a few miles away put a permanent tree stand up on my parents land when he gained access to adjoining property from the neighbor that lives behind my parents. The doctor did not know the property boundary.

This wasn't found out until my dad allowed a sheriff buddy to hunt my parents' property and he found the tree stand and tore it down. The doctor then tried for years to get access back, to no avail and even tresspassed a few more times before my dad sent him a letter from his company's letterhead. My dad is an attorney.

fence corner is about 40 yds behind the tree, perimeter trail as well so not hard to get to here.
