What does Texas parks and wildlife do with the rifles and shotguns confiscated by game wardens? Are they returned in most cases? Destroyed? sold?

I bet some of those poachers have some nice guns, I wouldn't mind bidding on them at an auction.

I am not sure anybody would answer on the grounds they may incriminate themselves...LOL>>. However, not by personal experience but one I observed....guns were confiscated for an offense and returned when restitution was made. There are some state auctions for siezed merchandise, I do know that.

can't swear to it but I was told that they sell and auction the seized firearms at "dealer-only" sales and auctions.

I know our city use to sell them at auction, but quite years ago, I guess liabiblity reasons.

i don't know about now but the charles whitman collection ( the ones used i the texas clocktower in the 60's) was sold. i beleive it was for 1200 bucks in the 70's and included his 6mm , his 30 carbine, a pistol and a sawed off 12 gauge

Some do destroy, not all; Some trade to dealers for something they need or want, guns/ammo; some sell/aution to dealers only. I know

It would make more sense to me to sell or auction them. That way, the police force that sells them could make a little money or swap them for "issue" weapons.

I believe in some cases, they give these firearms to certain hunting and shooting sports education programs. They also give some to youth hunting programs. The rest are sold and the proceeds go to Operation Game Thief.

most of the police and city auctions I have seen were only open to dealer/ffl

Nope! That firearm is under control of the state until such time as the case is dismissed or adjudicated. The Judge will then decide the disposition of the firearm (return, destroy, auction, or award to agency for use)

THat would just be wrong for the disposition to be up to the arresting officer. Could lead to a lot of wrongful confiscation. It needs to be decided by a panel. I have no prob with it goin into Op Game Thief.

Guys, lets dispense with the nonsense and "I heard..." BS.

There's a process. First, any weapon seized is evidence of a crime and must be maintained as such until the case is finally resolved. Then it's up to the judge, based upon the prosecuting attorney's suggestions. Each case is different, with a different disposition.

In some cases the guns are ordered returned to the owners. In some cases the guns are awarded to the state (arresting agency and prosecutor) or just the arresting agency. In some of those instances the guns are traded for equipment for LE. In other cases the guns are auctioned to FFL holders. In yet other cases the guns are destroyed.

It really is a case by case basis and there's no blanket policy on the matter.
