If one is 100 percent VA disabled and is getting VA disability, can one also draw social security disability?

It is possible, but getting it actually depends on the disability. Even with VA 100% disability the Social Security Administration still has to evaluate the disability and determine if it meets their criteria for disabled. If they decide that the condition is disabling then they will pay benefits based on earnings history. This page has a pretty good discussion:

Get your butt down to The Social Security Administration and turn in your paperwork you could get up to a year in back payments if I'm not mistaken.

If you have enough earnings credits you are eligible but you have to qualify through their process of qualification.

Yes it can be done SSDI is what your appalling for. Most of the time it will take about 6 months to a year, they will pay back pay based on the date you apply.up to a year, you can even get your interview over the phone.

Folks, there is a court precedent that if one government agency deems you totally disabled the others have to follow suit.

You will not get it if you don't apply.

If you are straight 100% or IU 100% with "no further review", your Soc-Sec will likely have no review. Soc-Sec will pester you with forms every few years though.

If your IU has "review" every so often, so will your Soc-Sec

The answer is Yes.

The SSA will give 100% T & P veterans expedited processing, but they do not automatically give disability based on the VA evaluation.

A VA compensation rating of 100% Permanent and Total does not guarantee that you will receive Social Security disability benefits. To be approved for Social Security benefits, you must meet Social Security’s definition of "disability." To be found disabled:

You must be unable to do substantial work because of your medical condition(s); and
Your medical condition(s) must have lasted, or be expected to last, at least one year or to result in death.

If you receive VA compensation, this will not affect your Social Security benefits.

Why do u think its expedited now?

You will get Soc-Sec based on your VA 100% but you have to apply.

You can also according to the VA CFR be eligible for IU with any percentage based on the intent statement of said CFR regardless of the fact that one of the subheadings says 60%

One should also know what the Soc-Sec definition for "substantial" is. One should also know what P&T translates to in VA verbiage (no further review)

They started the expedited process because they got tired of paying the Soc-Sec lawyers that Vets were hiring. Its about a 100% preceding loss in court for for the Soc-Sec Admin, and a Win-Win for the Vet and easy money for Lawyers. Before the expedited process only 6% of first time (did own paperwork) applicants received Soc-Sec disability because folk didn't understand the terms. It was close to 100% after the Vet went to a lawyer. Remember this when dealing with Gov agencies, they have monkey's who draw lines from the regulations to your application and supporting documents. If the fruit matches up, you get approved.

Neither organization is there to help you unless you apply. I encourage everyone in this situation to apply. I also encourage anyone not quite 100% VA to consult with a disability lawyer, your chances are real good. I'd much rather see a Vet get paid then some damn refugee!

There are no pictures in the regulations and comprehension is above the 6th grade level so a bunch of Army folk have trouble with this. (Friendly banter)
