How many of you have ever used a and gun or any gun to defend yourself or your family?

Only once, hopefully I never have to again. It's a miracle I didn't have to more with as much time as I spent on the road as a younger man. Let's just say nasty hotels and my nice stuff don't go together... That truck was brand new, I wasn't letting it go that easy.

Another question. Would you kill a man over a truck when your life was not in danger?

I have never had to pull out a gun, and hope I never do. I have heard way too many people talk like they cannot wait for the day that they do, crazy. Truck question- They can have the truck if it means taking a life, it is a simple possession and replaceable. And insurance will cover it.

Thousands of time in the military..maybe 8 times a civilian. A trespasser will get a gun pulled on him at my place in Southlake. Since I locked the back gate it doesn't happen often now.

In answer to your second question...... Yes and be within my lawful rights. I don't share the liberal concerns of taking a criminals life.

I recently had another CPI presented to the grand jury and I can't begin to tell you the stress is causes. 9 of 12 have to true bill to indict, but in todays world, anything is possible. Using deadly force to protect property is just asking to lose your life as you know it.

I've never had a bad car crash, but I wear my seat belt. Never had my truck catch on fire, but I have a fire extinguisher.
Nope, never had to defend myself using my gun.

A Democracy is when two wolves and a lamb vote on the dinner menu. That is why this country was specifically not designed as a Democracy. We are a Constitutional Republic.

Using deadly force to protect property is just asking to lose your life as you know it. It is clearly written in Texas law that a person has the right to do so. It is not even a grey area, I've recently read it.

1: Yes.
2: I believe the act described would be classified as Theft and therefore you do not have the legal right to use Deadly Force during the day. At night if there is no other means of recovery of the truck and an the act of recovery would place you at risk of death or harm then you can employ Deadly Force.
I am not an attorney nor did I stay at a Holiday Inn last night but that is my understanding of the Code.
IMHO it would not be worth the risk and cost, call agent and wait for the check.

Rarely would a would be car thief not use some sort of weapon in a daytime robbery. I'm not going thru deductibles and coming up with the money to get a new one. If I have a safe shot he's going down.

Texas grand jury terms are typically around 4-6 months and no, your lawyer doesn't get to pick anyone for anything related to a grand jury.

If I have a safe shot he's going down. Theft which was described by the OP is different from Robbery and there is a vast difference in how you can respond to each event. In case of Robbery then you are allowed to use Deadly Force.

Yes, Trespasser with a gun. Luckily he put his gun on the ground like I told him to. I had my gun ready to defense myself if he didn't.
No, I would not shoot someone over a truck.

First question, yes.
Second question, not that simple because there are too many variables. Most people have no clue until they are in the situation.

Jury trial for causing a death, 20,000 to 30,000 dollar range at least. The point being missed here is that regardless of what the codified law states or how justified you believe the shoot was, the grand jury can true bill and trash the next year of your life and then never even have to explain why the indictment was done. Happens all the time. Shooting someone over property is not worth the property.

I have no doubt it would cost that much. That's why it is important to have insurance such as Tex law shield. I do doubt that the grand jury's in Tex pass many if any cases of legitimate shoot car theft cases to trial.

One of the men I work with shot and killed a thug breaking into his company tool truck in Tyler. He shot him with a .357 from the second floor window. This was after several break ins. He was given a reward for catching the thief.
