I am considering purchasing a used ATV/UTV for hunting my property in East TX. I spoke to gentleman about one but he does not have a title. He said it was never titled because it was originally purchased in Oklahoma and they don't require titles. He will provide a notarized bill of sale. How difficult is it to get a title if it never had one?

It seems to me that as long as you keep it off of public roadways you don't necessarily need the title; bill of sale would be fine for proof of ownership. On the other hand, if you are planning on making it street legal then the story might change.

I would contact DVR. Even if you haul it on a trailer for hunting TPWD and TDPs are checking for stolen and need a title.

Might be worth a read...


"All-terrain vehicles (ATVs) and off-road motorcycles (ORMs) must be registered and titled in Oklahoma.
Register your ATV or ORM at your local tag office by completing an Application for Oklahoma Certificate of Title for a Vehicle (Form 701-6) and providing the manufacturer's certificate of origin or the original title signed over to you. You'll also need to provide a copy of the invoice or bill of sale you received when you bought the vehicle.
You'll follow the same registration and titling procedures as you would to register your standard car. Visit our Register Car in Oklahoma page for more information.
It will cost you $11 to title your ATV or off-road motorcycle with the Oklahoma Tax Commission."

If you get stopped they will check it for being stolen. Even if your hauling it on a trailer. They will pull you over just to check it. A bill of sale will not prevent them from confiscating it if it's reported stolen and possibly arresting you if they think they need to. These things get stolen all the time. The excuse he gave you is bogus.

I could be wrong but just my opinion. Another question, is it even legal to be pulled over just because you have a 4 wheeler on a trailer? That sounds like a really big stretch of probably cause.

You can get the vin/ serial number and see if it has been stolen other then that. There isn't a hard title requirement in Texas, since you don't have to register it. Always get a Bill of Sale though

You should still get the Certificate of Origin, that comes will all news ones iirc Makes ownership claim easier if it does get stolen and is similar to a title when needed to borrow on it as Vernon said. Bill of sale should be had on anything bought of value.

ATVs have been required to be titled since 1985.

UTVs since 2009 (with very limited farm use exceptions).

Who is pulling you over and where? What were you doing? That would be like stopping every pickup truck because they are getting stolen a lot, it doesn't make sense.

No, nor am I doubting you. Again, that just doesn't make sense....Makes a little more sense that it was a GW, but still that is a real stretch of the law to pull over anyone hauling an ATV just because they are hauling it. You are the only person I've heard that happening to. It might make sense if you were leaving a public hunting area, or something like that but just driving down the road, he must have been bored.

I would hope that is the case, I guess it just makes me mad even thinking about that situation. Sure, if an ATV had been stolen an hour before and you were matching the description I can see that, but just pulling people over because they have an ATV in the back is BS.

I didn't appreciate it at the time but the more I thought about it I was glad they were at least trying to find it for the owner. I get the impression more times than not they never try to pursue it unless it lands right under their noses.

It's a "thing" with different areas that pops up now and again when there have been lots of trailer/ATV/UTV thefts.

It's really more of a "see if the guy acts nervous" kind of deal because since (at least for ATV/UTVs) they are not registered and you are not legally required to have your title with you. They simply check the trailers since they are registered.

I have been stopped and asked about mine too. I played along since I was in a good mood, but the fact is it was nothing more than "fishing/harassment" since I was doing nothing wrong to justify the stop in the first place. If I had argued I'm sure they would have just said my ATV matched the description of a stolen one too.

My neighbor has an old Honda. I think it's a 1984 or 1985 model. He bought it used way back in the late 80's, and just like a Honda, nothing broke for decades. Finally he had some sort of problem and took it to the Honda place. They later told him that it had been stolen a year or two before he bought it. But, according to him, since it had been so many years, (30) they just fixed it and billed him.

If I ever got stopped and asked for an ATV title for my old Yamaha, I guess they'll just have to arrest me or shoot me. I guess I have a title somewhere, but where?

I bought two ATVs, one in Lubbock in 2013 and one in Fredericksburg in 2002. I don't think I have the title for either one. I can understand buying one in OK if you are from Texas and not registering it.

That sounds about right. That just seems like someone that wants to be a PITA and not really someone concerned with catching someone.

I had to chuckle as one of my co-workers is the most paranoid human I know about rules/laws. He bought a ATV and made sure he had all the paperwork necessary and would not haul it to his lease until he got the title back. The first time he hauled it to his lease in Mason county, he got pulled over and got checked, but he had the title with him to show the LEO. He asked the LEO what would happen had he not had the paperwork with him, and was told they would merely run the VIN thru their database over th radio and it would have taken a few minutes longer.

To that point, I have owned several Kubota RTVs that I bought thru heavy equipment auctions without any form of paperwork except receipt from the auctioneer. But the auctioneer is bonded and has all vehicles (tractors, trailers, UTV, ATV, cars, Trucks, etc.) VINs run thru the proper checks to insure they are not stolen (although I guess some could be recently stolen and not be in a database anywhere yet).

I got pulled over by a state trooper. I was hauling my 4 wheeler on my trailer. The "reason" he pulled me over was because my license plate on my truck was to "dirty" and he couldn't make it out. Kinda hard to do hauling a 4 wheeler and a trailer I thought!!!
Anyways, guess who was riding with him? A GW. The GW ran the vin # and even told me they were stopping everybody with a 4 wheeler that night. He also checked my hunting license, my son's hunting license, and my cooler.
This was on Hwy 79, just as I crossed the Trinity River a few years back.

My cousin once borrowed my Grizzly and got pulled over not 2 miles after leaving my house. Cop says he was looking for stolen 4 wheelers
