skinnerback, I doubt if doing your business through Academy had anything to do with the delays you've experienced. And, by law, Acadamy should not sell a person a gun until they get NICS clearance for that transaction. I'm a small dealer, and a lot of my transactions are with repeat customers who've bought lots of guns from me before, but they all know that I will NOT transfer the firearm to them until I get the NICS clearance. As mentioned by several other posters on this thread, get out there and get yourself a concealed handgun license and avoid the NICS approval process all together! Roger that I have my CHL now. You mentioned "by law" the dealer has to wait for the NICS clearance. Did that just change recently? Last I new the law said if you were delayed you only had to wait three business days not including the date of transaction to hear back, then by law the firearm had to be released. Store policy could always say no release until cleared though. Even the manager at Academy told me the law says 3 days but store policy says no relase, even if that meant months before they heard back. Oh and my beef with Academy was their store policy, that and I don't care much for their gun selection anymore anyway. Nearly impossible now to find a rifle with a wood stock there and they won't even order for you.

If NICS response is cancelled or denied, the seller is prohibited from transferring the firearm. If NICS provides a delayed response, the seller is prohibited from transferring the firearm unless three business days have elapsed, and, before the transfer, NICS or the State has not advised the seller that the buyer's receipt or possession of the firearm would be in violation of the law.

This kind of thing is exactly why I got a CHL. I'm not concerned about any actual problems with my record, just erroneous crap, system problems, etc. Getting a license makes all of that go away unless the FFL runs everyone. CHL = backdoor licensing law. One method for closing the “private sale loophole” and ensuring that every person who purchases or possesses a gun has undergone a background check. Other states close the private sale loophole by requiring a background check at the point of sale of a firearm. Licensing laws that require periodic renewal can also help law enforcement confirm that a gun owner remains eligible to possess firearms, and can facilitate the removal of firearms from people who have become ineligible. Longer and longer wait times and folks decide to obtain their CHL to avoid the delay, before long, everyone will be licensed, in the disguise of 'concealed hand carry'.
