Assuming you have a CHL and are carrying in your auto. If you are stopped by an leo and your weapon is not concealed....are you in violation of the law???

Thanks..I was asked by a friend who just got his CHL. And I couldn't answer him. I don't remember that they covered that when I got mine 7 years ago...although I do conceal in the car or not. I guess a good CHL instructor would be certain to cover it today.

It's not really a chl issue I think it's moreso covered under the castle law, either way though it must be concealed.

Garrett,

I keep a pistol (in a holster) in my driver's side door panel. Me left leg effectively covers the pistol, especially if I push my leg up against the door. I've been pulled over more than once, explained to the officer that I had a loaded handgun in the door panel, and have never had a problem.

GC §411.171. DEFINITIONS. In this subchapter:

(3) “Concealed handgun” means a handgun, the presence of which is not
openly discernible to the ordinary observation of a reasonable person.


PC §46.02. UNLAWFUL CARRYING WEAPONS. (a) A person commits an
offense if the person intentionally, knowingly, or recklessly carries on or about his
or her person a handgun, illegal knife, or club if the person is not:
(1) on the person’s own premises or premises under the person’s control; or
(2) inside of or directly en route to a motor vehicle or watercraft that is owned
by the person or under the person’s control.
(a-1) A person commits an offense if the person intentionally, knowingly, or
recklessly carries on or about his or her person a handgun in a motor vehicle or
watercraft that is owned by the person or under the person’s control at any time in
which:
(1) the handgun is in plain view;
