I know this has been on here before but I cannot find it. Shipping a handgun within Texas legal?

Handguns must be shipped to a dealer even in the state. Long guns can go person to person.

Per the ATF it is legal to ship a pistol to another resident of the same state using a common contract carrier (FedEx or UPS).

Quote:
Q: May a nonlicensee ship a firearm by common or contract carrier?
A nonlicensee may ship a firearm by a common or contract carrier to a resident of his or her own State or to a licensee in any State. A common or contract carrier must be used to ship a handgun. In addition, Federal law requires that the carrier be notified that the shipment contains a firearm and prohibits common or contract carriers from requiring or causing any label to be placed on any package indicating that it contains a firearm.

[18 U.S.C. 922(a)(2)(A), 922(a) (3), 922(a)(5) and 922(e), 27 CFR 478.31 and 478.30]

Yep thats how I read it, and since the ATF chapter and verse has been sighted and documented I would go with that.

NO FFL FOR HANDGUNS IN TEXAS!!!! or at least thats how I read it

Not legally, that's just shipper policy. Ffl's can send handguns Priority Mail.

So if I were to buy a AR from someone on here they would have to ship it to a dealer?

Doesn't matter if it is a rifle or a pistol as long as you are residents of the same state...

Thanks KC that was the point I was trying to make.

As in the question was about pistols, I thought the rifle subject was clear; lots of people are confused about the situation.

Try walking into a UPS/Fedex store and telling them you want to ship a rifle...."uh we cant do that!"

stand your ground and tell them you can with out being to big of a smart A$$ and eventually they will get around to calling corporate and getting things straight.

I have a printed copy of their policy on firearms, that always cuts the clutter...

Fed-EX and UPS will NOT ship firearms unless you are a dealer with your FFL in hand.
UPS Firearms Shipping policies

Fed-Ex Firearms Shipping policies

Now an individual CAN ship a long gun interstate via USPS without going through an FFL, and I believe you can ship either a hand gun or long gun via private carrier if they accept the responsibility.

From the UPS link:

"and from and between persons not otherwise prohibited from shipping firearms by federal, state or local law and when such shipment complies with all applicable federal, state and local laws applicable to the shipper, recipient and package."

From the FedEx link:

"Where not prohibited by local, state and federal law, from individuals to licensed importers, licensed manufacturers or licensed dealers (and return of same)."

That's wrong and your link proves it.

I guess I should be on the lookout for the feds to arrest me for the Marlin I shipped last year through Fed-Ex.

I guess I am not reading/interpreting this correctly

Look at the bottom where it say not otherwise prohibited....; the punctuation is the key.

Guess comprehension is owning me because I am still reading even under the where not prohibited it is only from an individual to a licensed receiptient....

Sounds like you have actually shipped Fed-Ex, so if they knew you shipped a rifle sounds like they will do it.
I don't have any history of shipping through any other company other then USPS so I can only go off what I was told and read.

Yeah I walked right in the store with and they treated the same as any other package.

I'm not making fun of your grammer so don't take it that way. What the paragraph is doing is pretty much listing people who can ship with commas instead of bullet points.

I did not take it as you were, kind of a stab at my self....

This is where I am confused. Can an individual send to another individual via Fed-Ex?

I am not seeing to another individual listed there.....

Federal law says you can ship any gun person to person in the same state......

Another federal law says only FFL's can ship handguns via United States Post office.

Fedex and UPS both ship tons of crap that they are and aren't supposed to ship. Both have policies against individuals shipping guns on paper, but they love to have your money and ship it anyway... Corporate policy be danged...

Both FEDEX and UPS require AIR FREIGHT on Handguns (for FFLs or individuals) (If they know its a handgun and follow corporate policies)... this is a company money maker NOT a law.

My only concerns are these:

1) RUN from someone that refuses to go through an FFL.....

2) If you do ship a handgun, say 3 day ground on UPS, and it gets lost, damaged or stolen, when you try to collect insurance on it, they have an OUT.... sorry YOU violated our policies...
